Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19 and Visiting Old City Cemetery
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is very contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
The Southern Memorial Association that manages Old City Cemetery (SMA-OCC) has put in place preventative measures to reduce the spread of COVID-19; however, SMA-OCC cannot guarantee that you or those in your care will not become infected with COVID-19. Further, visiting SMA-OCC or attending SMA-OCC events could increase the risk of you and those in your care contracting COVID-19.
Old City Cemetery is an historic Cemetery that dates back to 1806. The terrain of the cemetery may be uneven and contain tripping hazards such as tombstones and depressions in the ground and part of the main drive consists of uneven, historic cobblestones. Visitors walking the property are advised to take special care to observe where they are stepping. Visitors or tour goers who are walking in the dusk or dark are encouraged to bring a flashlight to help in this setting.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that those in my care and I may be exposed to or infected by COVID-19 by attending the SMA-OCC Candlelight Tours and that such exposure or infection may result in personal injury, illness, permanent disability, or death. I understand that the risk of becoming exposed to or infected by COVID-19 at OCC may result from the actions, omissions, or negligence of myself and others, including, but not limited to, SMA-OCC staff, volunteers, and program participants.
By signing this agreement, I acknowledge the risk of walking on the uneven terrain of the cemetery grounds and voluntarily assume the risk that those in my care and I may trip, fall, or be injured and that walking on uneven terrain may result in personal injury, illness, permanent disability, or death.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to those in my care or myself (including, but not limited to, personal injury, disability, or death), illness, damage, loss, claim, liability, or expense, of any kind, that I or those in my care may experience or incur in connection with our attendance on SMA-OCC tours or events. On behalf of myself, and on behalf of those in my care, I hereby release, covenant not to sue, discharge, and hold harmless SMA-OCC, its staff, volunteers, and representatives, of and from all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of SMA-OCC, its staff, volunteers, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any SMA-OCC program.
